Ok, this guy is a real special case.

He's intending to use content that was exclusively licensed to us (TrikePatrol) to build his own website.

Even told us so directly.

He does not give two shits about the DMCA law.

Through a tip, we were able to get a peek at the early beginnings of his "site". (quite pathetic looking so far)

I have already contacted the host, iPage.com, with a DMCA notice. I hope they will comply and do the right thing. We'll see what happens.

If by any outside chance they do not, I would expect that no upstanding Asian niche webmaster would support or promote this individual who has absolutely no regard for doing business honorably.

Unfortunately you will find Mr. Jimmy Regina, that all the crying in the world will get you absolutely nowhere. You state that CLEARLY 7 images YOU OWN have been used on my MOCK splash page... well you are for fact WRONG. You even KNOW you are wrong because had you been right, the 7 images in question would be found EASILY in your sample galleries you have listed links for in a shameless attempt to discredit me while getting YOUR website associated with mine! lol

NOT EVEN ONE of the photos in your galleries can be isolated as an example/EVIDENCE of any image you own outright.

You are crying. Nothing more. You know that you are on your way out. When I stopped selling content to you, you lost 50% of your subscribers. Your numbers have continued to plummet after the fact to even lower numbers than BEFORE I sold content to you.

Your fans became my fans. When you no longer uploaded content that i produced for you, your fans defected on you. Now that I am about to launch my own site, your fear of the inevitable has you shaking in your boots son.

For even one minute in your accusations, do you honeslty believe ANYONE will buy into your dramatic little story? Let's put it this way... if I had used 7 imagess belonging to you... why on God's green earth did you not illustrate your point by displaying the exact image? Or are you actually delusional enough to believe that just because I sold SOME content of a particular model to you... do you actually believe you own the rights to work she has done for me on top of the work of hers that I sold to you? Get a grip sir. The real world does not work that way and you sir do not OWN PEOPLE NOR the rights to the work they do when it is not sold to you to begin with.

You would think for credibility's sake you would AT THE VERY LEAST SPECIFY those "7 images used directly from... " your website. Yet you fail to even mention ONE. Instead, you give examples of the same models... one of them even wearing a different hairstyle even. (comical)

Give it up and get a regular job and live out the rest of your days wishing you had met my demands for a higher price instead of gambling (and losing) on the bet that I could not survive without you.

Can you provide irrefutable evidence of that like I can produce irrefutable evidence that in a temper tantrum your company has endangered my life and the lives of my family and friends by posting confidential information about my identity and home address in the US? I can see you are in dire need or returning to school for an education sir. And you need to grow up and accept the fact that I am your competition. And I just so happen to do what you do... only I do it MUCH better than you ever could or even can now. You learned nothing from me. Instead your temperamental childish outbursts like this have caused the public eye to be drawn into your controversy in the HOPES that it garners you some attention.

The truth is too easy to prove Jimmy. Lying, will only make you look like a complete ass... and a rather petty one at that.

Thanks for your opinion on my site so far by the way. lol, so good of you to notice ;-) Try to remember though, your opinion does not matter when dealing with a competitor. The only opinion that matters... is the consumers. I think the only thing at this point that could be considered " (quite pathetic looking so far) " is your weak attempt to delay my launch in one hand while desperately attempting to associate your website with mine. We both know what will happen though, Jimmy. Nothing. Problem for you, Jimmy, will be that in reply to their inquest to me, I will merely forward them to this discussion forum and allow them to rightfully decide who is being honest, and who is just afraid of the competition. You cannot prove your claim. You never will be able to prove your claim as it is false. Deal with it. I am not going anywhere sir. I will compete with you, and the better content provider will enjoy the rewards.

Once again, those models are of videos we own. You relinquished ownership of that content when you sold it to us. You need to re-read the contract you signed, and then read it again. It doesn't matter at all, whatsoever, who filmed the content because we own it. How hard is that to understand?

I guess I'll have to say good job on keeping a few images of the other models during those shoots and not giving us all the content; so I can't provide exact sources for those. But no matter, if your site ever actually goes live and you use our videos and photo galleries, that'll be far more than enough proof to have you shut down for content theft. The 3 images I posted here are just the beginning of a very long road for you if you decide you're going to steal from us.

PS. No lawyer in their right mind, especially not one that you can afford, will even take your case because the contract you signed is implicitly clear. Just because you don't think you have to abide by it, does not mean it's not legally binding.

Again, this guy is so funny. So he sells us 10 or 12 video/photo sets, to add to the 100 (and counting, check the site) we already have, and he acts like he's some sort of "Porno Pariah", lol. Talk about a major narcissist complex, jeez.

We're not saying he can't re-shoot the same models for his own use or resale to other parties. Sure, go nuts.

All we're saying is that if he re-uses any photo or video that was sold exclusively to us as per the written agreement he signed, it will be dealt with.

And from prior comments made by him and some of the images already on his under construction Under Developement - Home site, he is intending to do exactly that.

That is stealing and cheating 101.
